Only one hangtag should be distributed to renters during their stay. Hangtags are re-usable and owners are responsible for keeping ownership of the tags. Replacement tags are $15.

Owners are responsible for any damages to the building/elevator when moving in.
When moving in please schedule a date and time so that elevator padding can be installed. Schedule with HOA president.

Owners are permitted 2 pets in their units. Renters are not permitted to bring pets.
The Carolina Surf HOA requires registration with the Association of all pets that will be kept in a unit in the building.

I. INTRODUCTION
The Carolina Surf Homeowners Association and our Board of Directors welcome you to Carolina Surf! We take great pride in our Property and feel sure that you will do the same. To keep our investments and Carolina Surf operating properly and looking its best, the following Rules and Regulations as outlined by your Board of Directors must be adhered to by all owners, tenants and guests. The Board of Directors can be contacted for further clarification, exception or appeal. Comments may be directed to the property management company.

IV. GENERAL
A. The Carolina Surf property includes the building, owner units, decks balconies, landings, pool area, beach access, grounds, parking areas (limited and general common areas, i.e., the Property).
V. ASSESSMENTS (DUES AND SPECIAL)
A. Payments of assessments shall be made to GO Property Management.
B. Payments made in the form of checks shall be made to the order of the association (Carolina Surf HOA).
C. Payments may also be made electronically by credit card, electronic check or debit card at www.gopropertymgt.com (additional fees may apply).
D. Assessments are due on or before the first day of each month. Special Assessments will be due as directed by the Board of Directors. E. Assessments that have not been paid by the end of the month they are due are considered delinquent and are subject to additional fees. Please reference the Carolina Surf Collection Policy.
VI. PARKING
A. Automobile parking spaces shall be used solely and exclusively for the purpose of parking while staying in a unit in the building. They shall not be used for the storage of boats, trailers, campers, motor homes, golf carts, bicycles, motorcycles, inoperative automobiles or the like (list not inclusive).
B. 1 parking space is guaranteed at any time per unit. During non-busy times/off-season, more than one vehicle per unit can be parked if space is available and vehicle has the proper permit (owners and owner’s family/guests only). The 1 parking space per unit for short-term renters is in place year-round.
C. A parking pass/sticker must be displayed in the window of any vehicle parked in the Carolina Surf parking garage.
D. Parking stickers for owner & family vehicles will be distributed during the annual vehicle registration process and when a unit changes ownership.
E. Each unit will receive 4 parking passes for guests, but only one should be distributed per renter. Parking passes for short-term/vacation rentals (1 pass per unit per week) must be hung on the rearview mirror with ALL blanks completed including unit number, contact number and dates of occupancy legibly printed and hanging facing outward. Owners are responsible for getting re-usable guest parking pass back from renters.
F. Parking enforcement will be managed for the HOA by Midway.
VII. PETS/SERVICE ANIMALS
A. A maximum of 2 Pets owned by unit owners and/or unit owner’s immediate family may be permitted in the owner’s Unit at any time.
B. All pets occupying the owner’s Unit must be registered with the HOA and have all proper shots or medications as required by the laws or restrictions for the protection of the health and safety of the public.
C. Pets are not permitted for short-term rentals (less than 3 months). Unit owners can request short-term rental access for service animals in advance and in writing to the Board of Directors by sending the request to: carolinasurfhoa@gmail.com.
D. A maximum of 2 Animals/Pets owned by unit owners and/or unit owner’s immediate family may be permitted in the owner’s Unit at any time.
E. Pets must be kept on a leash and under proper control when they are outside of a Unit.
F. The pet owner is responsible for the immediate removal of waste in a sanitary manner.
G. No pet may be left in a unit or on a balcony, unattended, for any period of time if the pet creates a nuisance to other residents (i.e., barking, scratching, howling, etc.).
H. The Unit owner shall be deemed to have indemnified and agree to hold the Carolina Surf Homeowners Association, its Board of Directors, and all individual Unit owners free and harmless from any loss, claim or liability of any kind arising by reason of keeping or maintaining such pet within the condominium. The Unit owner shall maintain the necessary insurance to cover this liability.
VIII. PROPERTY MAINTENANCE
A. Only the HOA property manager (or agent thereof) is authorized to give instructions to or direct the activities of the HOA’s onsite maintenance and cleaning personnel. Requests for service by Unit owners must be made through GO Property Management’s website.
B. Complaints by Unit owners regarding the service or operation of the condominium shall be made in writing to the Board of Directors and the Property Manager.
VIIII. PROPERTY RULES
A. Stair tower, garage level bathroom and pool doors are secured with an access code and these doors should remain locked at all times. Do not share access codes with anyone who does not need access to these areas to ensure the security of our building. Access codes will be changed periodically as necessary to ensure building security. When changed, Unit owners will be notified in writing.
B. The elevator access code will be shared with Unit owners in writing. This code should not be shared with anyone who does not need access to the elevator to help ensure the security of our building. This code will be changed as necessary to ensure building security. When Changed, Unit owners will be notified in writing.
C. Any Unit owner who is moving in to or out of a Unit, and/or having furniture and/or appliances moved in to or out of a unit, must contact the Board of Directors in advance and in writing so elevator padding can be installed in the elevator. This will ensure that the interior does not get damaged during moves and deliveries to protect this expensive investment. Any damages incurred will be charged to the resposible party.
D. No owner, guest of an owner, or tenant shall post any advertisements, posters or signs of any kind in or on the Property or within their unit. This includes signs: “For Sale”, “For Rent”, “For Lease” and the like.
E. Entrances, halls, walk ways and stairways of the Property shall not be obstructed or used for any purpose other than ingress to and egress from the Property or Unit.
F. Towels, clothing or like objects shall NOT be hung or shaken from doors, windows, walkways, railings or corridors of the Property.
G. None of the common elements of the Property shall be decorated or furnished by any owner, guest of an owner or tenant. Nothing shall be altered or constructed in or removed from the general common area or elements of the Property.
H. The Unit owner, guest of an owner or tenant shall not make excessive noise between the hours of 9 pm-9 am. This includes, but is not limited to playing a musical instrument or operating a phonograph, radio, television or other loud speaker in a unit at an excessive volume level.
I. Unit owners, guests of an owner, tenants, repair persons, employees, agents and visitors shall not at any time or for any reason enter upon or attempt to enter upon the Roof or common area Utility Rooms (electric, pool, elevator, HOA storage, area past fenced Unit space on rooftop decks). Repairs or servicing of items on the roof or in the common area Utility Rooms of the Property must be scheduled with the Property Management company in advance and approved by a Board Member. Access to the Roof for 4th floor unit owners (in order to place (or replace) furniture on their rooftop deck), must be scheduled in advance with the Property Management company approved by a Board member.
J. Gas, wood or charcoal grills, smokers or other cooking appliances are forbidden on decks or under the building by order of the Carolina Beach Fire Department.
K. Smoking is not permitted on the property.

M. Personal possessions must not be left in the limited common or common areas, including the parking area, pool area and unit walkways. When not in use, all items must be stored inside the unit. The HOA is not responsible for items damaged or stolen from the limited common or common areas.
N. Feeding birds is strictly prohibited on the Property, including, from the decks, pool area, or parking lot.
X. SHORT-TERM, LONG-TERM & VACATION RENTALS
A. Owners must register their unit with the HOA if they will be renting their unit (short, long-term or vacation).
B. Any Unit owner that leases their Unit on a long-term basis (more than 3 months) must provide the Board of Directors with a copy of the lease. It is the responsibility of the owner to ensure that their short-term guests (and/or management company) understand and communicate this information accordingly.
C. Unit owners must include proper language in their lease/rental agreements to allow for lease termination for violations of the Occupant Regulations and Guidelines.
D. Each Unit owner, their family members, tenants, guests and service personnel are subject to the these Regulations and Guidelines and Occupant Regulations and Guidelines of the Carolina Surf Homeowner’s Association.
E. Each Unit owner is responsible to ensure that tenants (and property management companies managing tenants/renters) are provided copies of these Regulations and Guidelines and Short-Term Renter Rules.
XI. TRASH/RECYCLING/REFUSE REMOVAL
A. All trash and recycling shall be deposited in the trash dumpsters and recycling totes located at the exterior area on the south end of the building.
XII.UNIT MAINTENANCE, CONSTRUCTION & GENERAL INFO
A. Unit owners are requested to maintain interior temperatures of no less than 45 degrees Fahrenheit.
B. Costs, or any portion of costs thereof (including the deductible), not covered by the Homeowners Association insurance policy for repairs or damages resulting from plumbing fixtures or apparatus exposed within a unit will be the responsibility of the Owner in whose unit the problem initiated. 1. Examples of problems under the control of unit use that can cause damages to other’s property include: overflowing bath tubs, shower water leakage into walls at tub/wall joints, overflowing commodes, improperly installed plumbing fixtures and hoses, washer hoses and water pipes bursting in winter, etc. Owner’s must maintain units to control such issues.
C. The exterior of any Unit, which includes balconies and rooftop decks, as well as Unit entry doors and door areas to each Unit, shall not be decorated by any owner, guest of an owner or tenant in any manner. This includes, but is not limited to: Non-standard furniture, artwork, chimes, signs or advertisements.
D. No shades, awnings, window guards, hurricane shutters, screen doors, window treatments, ventilators, fans or air conditioning devices shall be used or installed on the exterior of any Unit, which includes Unit front doors, storage doors, windows, sliders, balconies and rooftop decks.
E. No permanently affixed door signage can be attached to any exterior door of the Unit. Drilling or nailing holes in any exterior area of the Property is strictly prohibited and could result in a fine. This includes unit owner’s name, unit number, unit name, wreath, décor or placquard.
F. Front entry area, balconies and other limited common areas must be kept in a neat and tidy order, free of trash, trash containers, debris, toys, etc.
G. A reasonable amount of exterior patio furniture is acceptable Unit and rooftop balconies. Items may not be put on the balcony that pose a safety risk to others by flying off the balcony in a violent wind. Owners are responsible for securing their balcony furniture when their unit is not regularly occupied and when advised to do so by the Board of Directors due to inclement weather. This service can be requested to be completed by the Property Management company (fee will apply payable by the requesting Unit owner).
H. No flammable, combustible or explosive fluid, material, chemical or substance, except those used for normal household use, shall be stored in a Unit and never in a common area space of the Property.
I. Unit owners, guests of an owner and tenants shall not install wiring for electrical or telephone installation, television antennas or the like on the exterior of the condo. All electrical equipment (appliances, televisions, etc.) installed or used in each Unit shall fully comply with all rules, regulations, requirements and recommendations of the Board of Fire Underwriters.
J. Any worked performed in an individual unit requiring construction (adding or moving electrical wiring, adding or moving plumbing fixtures, kitchen or bathroom remodels, installing new flooring, etc.) amounting to more than $30,000 requires the use of a NC approved general contractor. The GC shall obtain all appropriate Town of Carolina Beach permits and Carolina Surf MUST be listed as a named insured on the GCs insurance. All proof is on the burden of the homeowner to present this documentation to the Carolina Surf HOA Board of Directors for approval PRIOR to the commencement of construction. When in doubt, reach out to the Board of Directors for assistance and guidance to ensure adherence to the policy.
K. Any work performed in an individual unit requiring construction (adding or moving electrical wiring, adding or moving plumbing fixtures, kitchen or bathroom remodels, installing new flooring, etc.) amounting to less than $30,000 requires prior approval from the Carolina Surf HOA Board of Directors and insurance information for the contractor(s) performing the work must be submitted to the HOA with Carolina Surf HOA listed. When in doubt, reach out to the Board of Directors for assistance and guidance to ensure adherence to the policy.
L. Any damage due to inclement weather or leaking from a Unit owner’s unit or adjacent Unit owner’s unit MUST BE REPORTED IMMEDIATELY to the Carolina Surf HOA Board of Directors; send an email to carolinasurfhoa@gmail.com.
M. Each Unit owner has the responsibility of replacing or repairing all windows and doors including the frames, hardware and screens when necessary. Ripped, torn screens, or screens with loose or hanging or missing rubber piping is not permitted; screens must be kept in good working condition. When being replaced, the windows must match the existing dimensions and style (e.g. the crossbar/grid design and style of opening-double hung/sliding) and must be of acceptable color. The HOA Board of Directors approval must be obtained in writing prior to any replacements, upgrades or changes. Reference the Viwinco window warranty for information related to the window and door warranty prior to replacing or repairing windows or doors.
N. The Board of Directors, their agents and/or any contractor or workman authorized by the Board of Directors may enter any room or unit in the building with 24-hour written notification (except in case of emergency) for the purpose of taking such measures as may be necessary to control the situation and/or emergency.
O. Door knobs and locks cannot be changed on the exterior building doors (unit entrance door and exterior closet door) without express written approval from the Board of Directors. This is due to the ensuring the consistency of style on the exterior of the building and ensures that access to Units can be obtained by the Board of Directors or Property Management Company in the case of emergency (see item L above).
XIII. MISCELLANEOUS
A. Any units for sale or rent can be listed on the Carolina Surf website; send a request via email to carolinasurfhoa@gmail.com.
B. Any damage to the building caused by the moving or carrying of any article therein shall be paid by the Unit owner responsible for the damage. Any damage to the buildings, recreational facilities or other common areas or equipment caused by a lessee, children or guests of a Unit owner shall be repaired at the expense of the Unit owner.
C. The Carolina Surf Homeowner’s Association or any of its Board of Directors are not liable for any loss of or damage to personal property (including automobiles) that may occur on the property.
D. Video door bells (Ring and the like) cannot be installed on the exterior of the unit or adhered to the building.
E. All unit owners are STRONGLY urged to obtain H06 insurance to protect the interior of their unit.
F. These Regulations and Guidelines may be changed or repealed at any time by the Carolina Surf Board of Directors.
